This privacy notice for Referoo Pty Ltd ('Referoo', 'we', 'us', or 'our',) describes how and why we might collect, store, use, and/or share ('process') your personal information when you use our services ('Services'), such as when you:

1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

Personal information means any information about an individual from which that person can be identified. In this privacy notice, we have used ‘personal information’ and ‘personal data’ interchangeably.

We collect personal information that you voluntarily provide to us when you register on the Platform, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. We have grouped together the different kinds of personal information we may collect as follows:

  • Identity Data like your first and last name, your job title and work history and your date of birth, ID documents, biometric data
  • Contact Data like your phone number, email address, mailing address and contact or authentication data
  • Profile Data like your username and password, purchases or requests made by you, feedback and survey responses
  • Transaction Data like details about payments to and from you and other details of Services you have purchased from us.

Sensitive Information. When necessary, with your consent or as otherwise permitted by applicable law, we process the following categories of sensitive information:

  • job references which may contain sensitive personal information
  • criminal history
  • ID documents
  • biometric data

All personal information that you provide to us must be true, complete, and accurate, and you must notify us as soon as practicable of any changes to such personal information.

Information automatically collected

In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include:

  • Technical Data like your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, and other technical information;
  • Usage Data like information about how and when you use our Services; and
  • Marketing and Communications Data like your preferences in receiving marketing from us and our third parties and your communication preferences.

This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

Like many businesses, we also collect information through cookies and similar technologies.

The Technical Data and Usage Data we collect includes:

  • Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called 'crash dumps'), and hardware settings).
  • Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.
  • Location Data. We collect location data such as information about your device's location, which can be either precise or imprecise. How much information we collect depends on the type and settings of the device you use to access the Services. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your Location setting on your device. However, if you choose to opt out, you may not be able to use certain aspects of the Services.

Information collected from other sources

In Short: We may collect limited data from public databases, marketing partners, and other outside sources.

In order to enhance our ability to provide relevant marketing, offers, and services to you and update our records, we may obtain information about you from other sources, such as public databases, joint marketing partners, affiliate programs, data providers, and from other third parties.

Information received from third parties

We can often receive information about you from third parties. The third parties from which we receive information about you can include partner events within the marketing industry and other organisations that we have a professional affiliation with. It is also possible that third parties with whom we have had no prior contact may provide us with information about you.

2. HOW DO WE USE AND PROCESS YOUR INFORMATION?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To facilitate account creation and authentication and otherwise manage user accounts. We may process your information so you can create and log in to your account on the Platform, as well as keep your account in working order.
  • To deliver and facilitate delivery of Services to you. We may process your information to provide you with the requested Services.
  • To send administrative information to you. We may process your information to send you details about our products and Services, changes to our terms and policies, and other similar information.
  • To enable user-to-user communications. We may process your information if you choose to use any of our offerings that allow for communication with another user.
  • To save or protect an individual's vital interest. We may process your information when necessary to save or protect an individual’s vital interest, such as to prevent harm.

3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?

In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason (i.e. legal basis) to do so under applicable law, like with your consent, to comply with laws, to provide you with our Services, to enter into or fulfil our contractual obligations, to protect your rights, or to fulfil our legitimate business interests

The General Data Protection Regulation ((EU) 2016/679) (EU GDPR) and UK GDPR (as defined in section 3(10) (as supplemented by section 205(4)) of the Data Protection Act 2018) require us to explain the valid legal basis we rely on to process your personal information. As such, we may rely on the following legal basis to process your personal information:

4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We may share information in specific situations described in this section and/or with the following categories of third parties.

Vendors, Consultants, and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors, or agents ('third parties') who perform services for us or on our behalf and require access to such information to do that work. We have contracts in place with our third parties, which are designed to help safeguard your personal information. This means that they cannot do anything with your personal information unless we have instructed them to do it. They will also not share your personal information with any organisation apart from us. They also commit to protect the data they hold on our behalf and to retain it for the period we instruct.

5. INTERNATIONAL TRANSFERS

In Short: We do not transfer your personal information outside the country of collection.

6. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We may use cookies and other tracking technologies to collect and store your information.

We may use cookies and similar tracking technologies (like web beacons and pixels) to access or store information. Specific information about how we use such technologies and how you can refuse certain cookies is set out in our Cookie Notice.

7. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfil the purposes outlined in this privacy notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than the period of time in which users have an account with us. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

We will auto-delete any sensitive information after 30 days.

8. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organisational and technical security measures.

We have implemented appropriate and reasonable technical and organisational security measures designed to protect the security of any personal information we process. In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal information on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal information breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorised third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information.

Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

9. HANDLING OF DBS CERTIFICATE INFORMATION

If you engage Referoo to provide DBS checking services, you are required to handle all DBS certificate information in compliance with the Disclosure and Barring Service (DBS) Code of Practice, UK GDPR, the Data Protection Act 2018, and any other applicable laws or regulations. The following principles must be adhered to when managing DBS certificate information:

Storage and Access
Certificate information must be securely stored within digital systems that employ robust security measures, including encryption, access control mechanisms, and regular security audits. Access to certificate information must be strictly limited to authorised personnel as required for their duties. Access logs must be maintained to monitor use and ensure compliance.

Handling
Certificate information may only be accessed or shared with individuals authorised to receive it as part of their duties. Sharing information beyond this scope is prohibited and may constitute a criminal offence.

Usage
Certificate information may only be used for the specific purpose for which it was obtained, with the full consent of the individual to whom the certificate relates.

Retention
Certificate information must not be retained longer than necessary for the recruitment decision or relevant purpose. If retained for safeguarding audits, it must comply with applicable data protection laws and be specified in your data handling policy.

Disposal
Once retention is no longer necessary, certificate information must be securely deleted from all systems using methods that ensure the data cannot be recovered, such as secure overwriting or cryptographic erasure. No copies or representations of the certificate or its contents may be retained, except for essential details such as the certificate date, type, reference number, and recruitment decision. Backup copies containing certificate information must also be securely deleted in accordance with this policy.

Acting as an Umbrella Body
If you act as an umbrella body (receiving DBS certificate information on behalf of other organisations), you must ensure all parties involved have written policies for the compliant handling, usage, storage, retention, and disposal of DBS certificate information.

10. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services.

If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records.

11. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: In some regions, such as the EEA, UK, and Canada, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time.

In some regions (like the EEA, UK, and Canada), you have certain rights under applicable data protection laws. These may include the right to:

  1. request access and obtain a copy of your personal information,
  2. request rectification or erasure;
  3. restrict the processing of your personal information; and
  4. if applicable, data portability.

You will then be removed from the marketing lists. However, we may still communicate with you — for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

Cookies and similar technologies: Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services. 12. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ('DNT') feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognising and implementing DNT signals has been finalised. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

If you are using an authorised agent to exercise your right to opt out we may deny a request if the authorised agent does not submit proof that they have been validly authorised to act on your behalf.

Will your information be shared with anyone else?
We may disclose your personal information with our service providers pursuant to a written contract between us and each service provider. Each service provider is a for-profit entity that processes the information on our behalf.

We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be 'selling' of your personal information.

Referoo has not sold any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months. Referoo has disclosed the following categories of personal information to third parties for a business or commercial purpose in the preceding twelve (12) months:

  • Category B. Personal information, as defined in the California Customer Records law, such as your name, contact information, education, employment, employment history, and financial information.
  • Category I. Professional or employment-related information, such as business contact details in order to provide you our services at a business level or job title, work history, and professional qualifications if you apply for a job with us.
  • Category J. Education information, such as student records and directory information.

Your rights with respect to your personal data

Right to request deletion of the data — Request to delete You can ask for the deletion of your personal information. If you ask us to delete your personal information, we will respect your request and delete your personal information, subject to certain exceptions provided by law, such as (but not limited to) the exercise by another consumer of his or her right to free speech, our compliance requirements resulting from a legal obligation, or any processing that may be required to protect against illegal activities.

Verification process
Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g. phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes.
